Tecovas, Inc. (“Tecovas”) respects the privacy of others. This Privacy Policy ( “Privacy Policy”) is intended to explain Tecovas’s privacy practices with respect to your interactions with us such as when you visit our stores and visit our website(s) or digital properties (including but limited to mobile apps and order and purchase flows and our integrations into other services) that link to this Privacy Policy (together, the “Services”). This Privacy Policy is also intended to provide you (together with any person helping you visit, access, register with or use any of those online or digital properties, products or services, “you” or “your”) with an overview of the following:

• the types of information Tecovas collects about you;
• how Tecovas collects such information;
• how Tecovas uses such information;
• how Tecovas discloses such information; and
• Tecovas’s security measures for protecting such information.

Your continuing visit, access, registration with, subscription to or use of any of the forgoing reaffirms your acceptance and agreement in each instance.

1. Information We Collect.

Information you provide directly to Tecovas.

Tecovas may collect information about you through the Services. Depending upon your use of the Services and your interactions with Tecovas, the categories of such information might include:

• Contact Information: such as your name (first, last and/or middle), unique identifiers (e.g., username), mailing address, email address, and telephone number**, including contact information for third parties that you provide to us (for example, the name and email address of a gift recipient)**;
• Login information for the Services such as username, password, security questions and answers;
• Your electronic signature;
• Billing, payment or shipping information such as credit card or other payment method information, billing address (which is processed by our third-party payment processor);
• Transactional information such as your orders, shipping address, pricing, payments, item information, and shipping terms;
• Your business information (e.g., company, title, mailing address, email address, telephone number, facsimile number, tax ID number);
• Demographic information, such as your interests, preferences, age, and gender;
• Communications, research and feedback such as feedback you submit to us and questions and comments that you send us through online forms and social media platforms, by email, over the phone, in chat tools, by mail, or in surveys;
• Audio and video such as audio recordings of customer service calls or security video footage if you visit one of our properties;
• Content you submit such as comments, videos, photographs, images and information about such statements or content, which you submit or post on or through the Services or which are accessed via your public or linked social media pages (e.g., Facebook, Twitter, Instagram); and
• Inferences, which we derive or infer about your potential interests and behaviors based on other information we collect.

Information we collect automatically.

We may automatically receive and store certain information about the computer or device you use to access the Services or your activity on the Services. We and our vendors may use a variety of technologies, including cookies, to collect this information, such as:

• Information about your computer, mobile device, and/or browser (e.g., IP address, device IDs, operating system, connection speed, bandwidth, browser type, referring/exit web pages, web page requests, cookie information, hardware attributes, software attributes);
• Usage activity with the Services such as the time and duration of your use, browsing activity, search terms where you click on a site, keystroke activity, and how you interact with our emails; and
• Your geolocation when you use certain services (with your permission and in accordance with your device settings).

Information from Other Sources.

We also obtain information from other sources, like payment vendors who provide us with payment or balance information, analytics vendors, and security vendors, who provide us with information to secure our systems, prevent fraud and help us protect the security of the Services.

If you access the Services through a third-party connection or log-in (such as through sign in with Google), you may allow us to have access to and store certain information from such third-party services, depending on your settings on that service. If you do not wish to have this information disclosed, you may be able to adjust your account settings on those third-party services, or choose not to use these connections to access the Services. 2. How We Use Information.

Tecovas may use the personal and/or non-personal information it collects from you through the Services in a variety of ways, such as, for example, to:

• Provide the Services to you, including by processing your requests, fulfilling your orders;
• Communicate with you, including by sending you Services-related and marketing communications; communicate with third parties at your direction, such as sending gift notifications and shipping updates to gift recipients on your behalf;
• Understand your use of and make improvements to our Services and develop new ones, including carrying out research and analytics, creating measurement and analytics reports for us and others, and using artificial intelligence to improve our internal systems;
• Allow you to communicate with others through the Services, for example, through online forums, chat rooms, and bulletin boards;
• Personalize and advertise the Services, including by making recommendations for content you might like and advertising the Services to you on the Services and on other sites and platforms, and as further discussed in the Online Analytics and Advertising section of this Policy below;
• Comply with law, prevent and investigate fraud and other illegal activities, and for other safety and security purposes, including to protect or enforce Tecovas’s and/or its parent’s, subsidiaries’ or affiliated companies’ respective rights and properties, as well as to protect or enforce the rights and properties of others (which may include you); and
• For other purposes, with your consent.

Combined Information. For the purposes discussed in this Privacy Policy, we may combine the information that we collect through the Services with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Privacy Policy.

Aggregated/De-Identified Information. We may aggregate and/or de-identify any information collected through the Services so that such information can no longer be linked to you or your device (“Aggregated/De-Identified Information”). We may use Aggregated/De-Identified Information for any purpose, including without limitation for research and marketing purposes, and may also disclose such data with any third parties at our discretion. For example, we may use Aggregated/De-Identified information to create statistics that help us better understand Tecovas’s customer base.

Artificial Intelligence. We (including through our service providers) may use artificial intelligence tools (e.g., large language models) to assist us in processing your information for the purposes listed above as permitted by applicable law.

3. How We Disclose Information.

Tecovas may disclose your information, for purposes consistent with this Privacy Policy, to:

• Affiliates within our family of affiliated companies;
• Business partners to provide you with services that you participate in or request, such as co-sponsors of a promotion that runs on our Services. We are not responsible for the privacy practices of these entities;
• Service providers and other vendors who help Tecovas provide, manage, and market the Services, including web hosting, research and analytics, transaction and payment processing, promotion administration, artificial intelligence, fraud prevention, identity management, and other services, some of which may rely on artificial intelligence (e.g., large language models) for processing subject to appropriate restrictions and applicable law;
• Tecovas Trading Post sellers, when you purchase pre-loved Tecovas products from other Tecovas customers on our resale marketplace, and that seller is responsible for packing and shipping the item to you.
• Third-party marketing and advertising partners that provide advertising, content, or other functionality on and off the Services;
• Social media services, if you log into the Services with a social media service or if you connect a social media account with the Services. In that case, we disclose certain of your personal information to that social media service depending on your settings. The social media service’s privacy policy then applies to their practices regarding your information.
• Other parties when required by law or as necessary to protect our users and Services, including to comply with applicable law and legal processes, respond to requests from public and government authorities (including public and government authorities outside your country of residence), enforce our Terms of Service, protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or others, and allow us to pursue available remedies or limit the damages that we may sustain;
• Other parties in connection with a corporate transaction, such as any potential or actual merger, acquisition or other event involving a change in ownership or control of Tecovas or Tecovas’ business (whether by sale of assets, merger, stock purchase or otherwise);

• Other parties with your consent or when you direct us to do so.

4. Children.

The Services is a general audience website intended for use by adults. The Services is not designed or intended to attract, and is not directed to, children under eighteen (18) years of age. If you believe we might have any information from or about a child under 18, please contact us at privacy@tecovas.com, with a subject line of “Minor Information.”

5. Third Party Applications and Networks.

The Services and/or any communications sent through or as a function of the Services might contain links to third-party websites, networks, platforms, servers and/or applications (“Third-party Services”). Third-party Services might also contain links to the Services. In addition, you might have the opportunity to access the Services using your online user accounts with certain Third-Party Services, which might be subject to separate privacy policies pertaining to those third-party websites, networks, platforms, servers or applications. Tecovas might also collect information from those Third-party Services. You should carefully review the relevant terms of use and privacy policies associated with Third-party Services.

6. Security and Retention.

Tecovas implements a variety of security measures designed to help protect the information it collects through the Services. For example, Tecovas encrypts the transmission of information through the Services by using secure socket layer (SSL) technology. However, no method of transmission over the Internet or electronic system is completely secure, so there is no guarantee that such information may not be accessed, disclosed, altered, or destroyed in connection with a breach of our physical, technical, organization, or managerial safeguards.

To help maintain the security of your personal information, Tecovas asks that you please notify Tecovas immediately of any unauthorized visit, access or use of your account (e.g., username or password).

Tecovas may retain your information for as long as we determine it is reasonably necessary for the purposes for which we process it (e.g., as long as your account is active), or as needed to comply with applicable legal obligations. For example, we will also retain and use information as necessary to resolve disputes, protect Tecovas and our customers, and enforce our agreements.

7. Online Analytics and Advertising.

Consistent with your consent preferences and applicable law, we may use third-party technologies to engage in analytics and advertising.

We may use third-party web analytics services on our Site, such as those of Google Analytics. These vendors and service providers use the sort of technology previously described in the “Information We Collect” section to help us analyze how users use the Services including by noting the third-party website from which you arrive. The information (including your IP address) collected by the technology will be disclosed to or collected directly by these vendors and service providers, who use the information to evaluate your use of the Services. We also use Google Analytics for certain purposes related to advertising, as described in the following section. We also may make available information to third-party advertising partners for purposes of advertising our Services to you on Third-Party Services. We neither have access to, nor does this Privacy Policy govern, the use of cookies or other technologies that may be placed on your computer, mobile phone, or other device you use to access the Services by non-affiliated, third-party ad technology, ad servers, ad networks or any other non-affiliated third parties. Those parties that use these technologies may offer you a way to opt out of ad targeting as described below. 8. Your Rights and Choices.

Depending on your jurisdiction, you may have the right to make certain requests regarding your personal information. Specifically, residents of certain US states (currently including California Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia) may have the right to ask us to undertake the following if applicable:

• Confirm whether we are processing your personal information.
• Provide you access to and/or a copy of certain personal information we hold about you.
• Opt-out of targeted advertising.
• Delete personal information we hold about you.
• Change or correct personal information. You can edit some of the information about you. You can also ask us to change, update or fix information about you in certain cases, particularly if it is inaccurate.
• Transfer your information to a third party, where technically feasible.
• Withdraw your consent to processing of your information, where applicable and you have provided your affirmative consent to process your information for a specific purpose.
• Provide you with information about the financial incentives that we offer to you, if any.

• California and Oregon residents can request information about the categories of information we collect, disclose or sell or share about you; California residents can request the sources of such information, the business or commercial purpose for collecting or selling or sharing your information; and the categories of third parties to whom we disclose information. Such information is also set forth in this Privacy Policy.
• Oregon, Minnesota, and Connecticut residents can request a list of the specific third parties, other than natural persons, to which we have disclosed information.

You can make a request to exercise your privacy rights in accordance with applicable law through our webform (https://www.tecovas.com/p/data-rights-request). You may also contact us at privacy@tecovas.com (mailto:privacy@tecovas.com). We will take reasonable steps to verify your identity before fulfilling your request. Depending on your jurisdiction, you may submit your request through an authorized agent with written permission from you. Please note that if we receive a request from an authorized agent, we may still need to verify you before fulfilling the request. We will respond to your request within the time period prescribed by applicable law. Please note that many of the above rights are subject to exceptions and limitations and may impact your ability to use the Services.

Opt Out of Sales of Personal Information and Processing/Sharing of Personal Information for Targeted Advertising Purposes. While we do not sell your information in exchange for money, as explained above, we may provide information about your device and online browsing activities or hashed contact information to third-party advertising providers for targeted advertising purposes, so that we can provide you with more relevant and tailored ads regarding our services, and use analytics partners to assist us in analyzing the use of the Services and our user/customer base. The disclosure of your information to these third parties to assist us in providing these services may be considered a “sale” of personal information under applicable law or the processing/sharing of personal information for targeted advertising purposes.

If you would like to opt out of processing of your personal information for purposes that could be considered “sales” for those third parties' own commercial purposes, or “sharing” for purposes of targeted advertising, please click the “Your Privacy Choices” URL in the footer of our website. Please note that you will need to exercise your right separately on each browser and device you use to access the Services. Please note that we do not knowingly sell the personal information of minors under 16 years of age without legally-required affirmative authorization.

Please note that if you have a legally-recognized browser-based opt-out preference signal turned on via your device browser, we recognize such preference in accordance with applicable law.

Marketing Communications. You may instruct us not to use your information to contact you by email, postal mail, or phone regarding products, services, promotions and special events that might appeal to your interests by contacting us using the information below. You can opt-out of receiving further promotional emails from us by following the unsubscribe link provided in the promotional email you receive.

Regardless of your request, we may still use and disclose certain information as permitted by this Privacy Policy or as required or permitted by applicable law. For example, you may not opt out of certain operational emails, such as those reflecting our relationship or transactions with you.

10. Users outside the United States.

We are headquartered in the United States of America. Personal information may thus be accessed by us or transferred to us in the United States. By providing us with personal information, you consent to the storage or processing of your personal information in the United States and acknowledge that the personal information will be subject to the laws of the United States. We will process your information according to this Privacy Policy, regardless of where your information is processed or stored.

To the extent applicable, the laws in some jurisdictions require us to tell you about the legal grounds we rely on to process your information. To the extent those laws apply, our legal bases for processing your information as described in this Privacy Policy are as follows:

• Performance of our obligations under a contract or commitment to you. For example, we process your personal information to comply with our order and purchase agreements, and our website terms of service.
• In furtherance of our legitimate interests or the legitimate interests of others. For example, we process information to secure our services, to help Tecovas analyze how users use our platform, defend our legal rights, and prevent fraud.
• Compliance with applicable legal obligations. For example, we retain information for as long as needed to comply with applicable laws.
• With your affirmative consent. Where required by law, we process your information on the basis of your consent to processing for a particular purpose, such as to send you marketing communications.
